To be effective under 17 U.S.C. § 512(c)(3), your notification must be a written communication that includes substantially the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed (e.g., official broadcast feed, competition footage, specific televised fixture).
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit Trequa to locate the material (including specific URLs, tenant team identifiers, or match debrief references).
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law (such as fair use).
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Action upon receipt and counter-notification
Upon receipt of a valid and complete DMCA notice, Trequa will expeditiously remove or disable access to the infringing video or derived tactical assets and promptly notify the subscriber who uploaded the content.
If the subscriber believes the material was removed or disabled as a result of mistake or misidentification (for example, holding a valid league tactical analysis feed license), they may submit a Counter-Notification to our Copyright Agent containing:
- The subscriber’s physical or electronic signature and contact details.
- Identification of the material that was removed or disabled and the location where it appeared.
- A statement under penalty of perjury that the subscriber has a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- Consent to the jurisdiction of the federal or national courts having jurisdiction over the subscriber’s address or Trequa’s corporate domicile.
If a valid Counter-Notification is received, Trequa will forward it to the original complaining party. Unless the copyright owner files an action seeking a court order against the subscriber within ten to fourteen (10–14) business days, we may restore access to the material.
Repeat infringer policy
In accordance with the DMCA and applicable international law, Trequa has adopted a strict repeat infringer policy. We will terminate access to the service for any subscriber or organization determined to be a repeat infringer of intellectual property rights.
